Everyone has their own definition of open source; it's not a legal term. Whether doing something with a particular piece of software is permitted or not depends on the terms of the licence of that particular piece of software.

It's not illegal to sell software that someone else holds the copyright to, as long as you have permission to do so (whether granted by the licence or by the copyright holder). Software retailers sell closed-source copyrighted software all the time, after all.

Doesn't A1's manual mention it?

EDIT: From the BoA manual, Chapter 2, "The World of Avernum":

"According to mythology, Avernum is a gateway, the portal leading to the underworld". I think A1 gave a more detailed explanation.

Apparent genuine bug that MAY account for one crash: if you look southeast across the river from the area with the boat, you can see a weird graphical glitch one space west of the wall hanging. It doesn't crash my BoA, but Mac graphic routines seem to be more robust.

I'm getting occasional crashes at seemingly random times with this version, and I'm on a Mac. It's probably some kind of memory problem. Arenax mentioned that it seems to occur when too many different terrain or floor types are on screen at once.

Oh. Well, it's in the NW corner of the caverns under the bugbear city. Find the explosives in the caverns, blow up the pillar in the middle of the city (there are stairs in the middle of the caverns that take you there), go back to the caverns, find the passage that's opened up, take the symbol. Be prepared for tough fights after both blowing up the pillar and taking the symbol.

It's a demon, so Repel Spirit works on it. There's also a weapon nearby that could be useful. Other than that, just keep hasted, blessed and very well-healed.

Well, that error usually results from either an illegal argument passed to a call or a terrain with illegal properties (often a wall of height 0). Since state 38 doesn't seem to have anything wrong with it, it could be something to do with your terrain.

On the other hand, if it happens in several places, it could well be something you're doing throughout the town, like the sounds. Maybe the Windows version doesn't like you passing negative numbers to the play_sound call.

Problem: if a character enters the HLPM with enough disadvantageous traits to give a significant XP bonus (20% or more), the HLPM can raise their XP well above the XP required to attain the next level, causing them to gain many additional levels as soon as they earn XP. I think this is because a single XP award can only raise a party member by a single level, but each award is worth more XP than it takes for the party member to gain a single level, so additional XP accumulates. The only solution I can think of is to award XP in smaller increments.

EDIT: Reducing the XP award from 500 down to 150 seems to make it work acceptably even in the extreme case of a Brittle Bones, Completely Inept character, and doesn't cause script length errors even in the other extreme case of turning four Elite Warrior, Divinely Touched sliths into a god party.

Apart from being of higher quality, Japanese swords were also considerably heavier than Western swords, so it's not as if superior metallurgical techniques were the only difference. Overall, military equipment and tactics in Japan were much more oriented toward offence; whether this was a cause or a result of the fatalistic attitude of the Japanese military code is an open question.
