Measure 40 is one of my favorites for this year. It simply says that Oregon judges within the Supreme Court and Court of Appeals must represent disparate districts within the state and reside in those districts while holding office.

...

Now understand that Oregon is a big state. And there is only one Supreme Court, located in Salem. Does it make sense to force judges to drive up to 8 hours a day to go to work?
You can thank Kevin Mannix for this one.

Incidently, the biggest contributor of Opinion on this one is R Russell Walker, who decided to send in 22 manifestos (at $500 a pop) for his Our Courts Committee.

So, what do you think? Force Judges to maintain one residence and drive all the time? Perhaps they should maintain two residences? Or leave it as it was and let them live near their place of work?

Perhaps some compromise should be made. Maybe judges should be originally from certain areas, but be allowed to live in Salem.

It is an open, non-partisan election already. Any judge can run for the Supreme Court, whether from the Steens Mountains or from the west hills of Portland. The question is, why should they continue to live there during their tenure in the court?

They shouldn't. This kind of plan would only work in states like Rhode Island and Deleware. It's pure foolishness at best.

Especially given that the judiciary is not supposed to be representative. This is just a pointless roadblock of a policy. Do any of its backers have anti-"activist judge" agendas?

—Alorael, who thinks basing it on where judges were originally from would be even worse. How long do you have to live somewhere before you're from there? What are the age cutoffs? Does it have to be only a certain number of years ago? What if you, say, spent your summers there but the rest of the year somewhere else?

Judges don't deserve an unnecessarily long commute for absolutely no reason.

Dikiyoba might be in favor of herding the officials in charge of determining which high schools belong in which sports leagues onto a crowded bus for several hours a few times a week, though.

Argument in Favor
------------------------
quote:

Who are we and why do we support Measure 40?
In 1983 my husband and I, along with other parents of murdered children, created an organization named Crime Victims United.
Our Statement of Purpose: "To promote a balanced criminal justice system through public awareness and legislative action."
Our organization has battled for almost 23 years to make our purpose a reality. Our personal experience and legislative efforts have taught us:
Oregon's highest courts are consumed with the rights of the criminal defendant. If you live outside the areas of greater Portland, Salem, or Eugene, you will not be represented on the Appellate or Supreme Court.Oregon's Constitution has been extremely altered by judicial interpretations. Many who interpret our laws have no experience as trial judges. Our Constitution originally required higher court judges to be elected by districts.Who is in opposition?Oregon criminal defense bar.Oregon trial lawyers.Their justificationIt would be a hardship to travel to Salem.Supreme Court judges managed to bear this hardship from 1859 to 1910, they should be able to bear it in 2006.
Candidates from less populated areas would not be qualified to write opinionsThis elitest statement is inexcusable, especially considering some of the opinions written by Oregon's higher courts.
In my opinion, the real reason is that the defense and trial lawyers want to protect the advantage they have had in the courts over the last 30 years.
What to expect this measure to accomplishBring more representation to all citizens of Oregon/Seat more judges with trial experience.Provide knowledge of issues vital to the safety and economy of all Oregonians.Reduce pressure from self-serving individuals and organizations who disregard the impact on the rest of the state. Please vote 'YES' on Measure 40. It's simply fair and good government.Dee Dee Kouns
Founder, Crime Victims United
That is a sample, and not one of the many sent in by the Russell fellow. I liked this one because of the bullet points. They made me happy. Edited formatwise

You'd think that by now people would be taking advantage of new technology. Why not hold court through a video phone conference or something? Hey, if doctors can stay at home operating sophisticated surgery machinery (not sure if this is really done or if I saw it in a movie at some point), why can't judges hear cases from the comfort of their homes?

Sounds completely unnecessary to me. Judges have to deal with enough garbage in their work.

Salmon, making checkboxes that you can check only one of was very evil. Option 1 was too amusing not to check, so this measure has my support. :P

I still fail to comprehend the point of the law on the first place. Other than mess around with the poor judges that is. And as fun as that would be, it's just wrong. However, I did end up voting for option #1.

Edit: gahhh, all the speaking in third person is killing me.

-X- doubts that Terror's Martyr will decapitate him first, unless he is getting the misguided message that -X- presumes to control him... Hmmm... -X- supposes that, since he is not a noob, he now has the right to classify you as a "Will" in his Big Book O' Personality Classification.

-X- wonders what your arguments for his alleged noobness would be, as you have so far presented none.

1) Cheap posting gimmick
2) Pointless, spammy posts
3) Using gimmicks already in use
4) Low post count (though this only proves newb-ishness, not n00b-ishness)
5) Clear willingness to start flamewars
6) General irritibality
7) Tendency to start vapid, empty topics in General
8) Signature being longer than the average post

EDIT: Added #8

In respone to Esphesos,

1)-X- wants to know which gimmick you are talking about.
2)-X- is desperate to get rid of his "New Arrival" status. He has made spammy posts, but intends to stop once the count reaches 50.
3)-X- explained this in his first post.
4)True.
5)-X- doesn't want to start pointless flamewars, he wants to start arguments of that make sense and have meaning.
6)-X- is always irritable. This is normal.
7)See '2'
8)True.

Esphesos? Who is this guy? Anyway, I would like to reply:

1- Speaking in third person. Alorael is allowed because is Alorael, and Dikiyoba is a Master of a Cult. [And a pretty girl, in my opinion, can do whatever she want ^^]
2- Posting this way will give you a worse title: Canned. And after that one ever worse: BANNED.
3- Nothing to say.
4- There's nothing bad, everyone was a newbie.
5- Like everyone here.
6- Calm down then.
7- See 2.
8- Nothing to say.

EDIT: They are just compliments, ok?

I hate to break it to you, -X-, but being a newbie has little to do with your post count. It has to do with how long you've been here. To prove it, I have made over 250 posts, and am still considered a newbie. Why? Because I registered just last month.

Just relax and be yourself. Within the limits of the Code of Conduct.

-X- has technically been here for over a year, but newbihood has nothing to do with posts or time and everything to do with perception. Others' perception.

—Alorael, who considers everyone with a gimmick a newb. Yes, every single person who posts stupid gimmicks is a worthless waste of bandwidth.
