Now i may be imagining things, but i seem to remember situations in the Exile series where if you had, say a nephil in your party, people would react differently to you.

I havent looked very deeply into various scripting archives yet, but i have yet to see an example in any scenario i played and havent seen a script use it yet either. Is there such a command for BoA?

i dont speak leagalese very well, but take a look at this from the copyright office and tell me what you think.

quote:
§ 103. Subject matter of copyright: Compilations and derivative works

(a) The subject matter of copyright as specified by section 102 includes compilations and derivative works, but protection for a work employing preexisting material in which copyright subsists does not extend to any part of the work in which such material has been used unlawfully.

(b) The copyright in a compilation or derivative work extends only to the material contributed by the author of such work, as distinguished from the preexisting material employed in the work, and does not imply any exclusive right in the preexisting material. The copyright in such work is independent of, and does not affect or enlarge the scope, duration, ownership, or subsistence of, any copyright protection in the preexisting material.
And most importantly

quote:

§ 107. Limitations on exclusive rights: Fair use38

Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include —

(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;

(2) the nature of the copyrighted work;

(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

(4) the effect of the use upon the potential market for or value of the copyrighted work.

The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.
both taken from http://www.copyright.gov/title17/92chap1.html

Allright lets look at the fair use law.

1) Does tm use of the work have any commercial impact? No, it is for entertaiment purposes only and freely distrubuted.

2) The nature of the copyright work is graphics, but im not a copyright expert to say what that would mean in this case. Are any of you? No? Then dont touch this point. If you can say youve worked with the copyright office are are a copyright lawyer then go ahead.

3) Thats the 50% rule i was talking about earlier. I told you it did matter. It may not be 50% but still, it is a derivative of copyright work, and can fall under that provision

4) Will TM using someones graphics in a scenario that is at most probably going to be downloaded a few thousand times going to affect the market value or the market for a picture that isnt being sold anyway? Nope, not thinking so here....

btw, incase your wondering sections 106 and 106a deal with who has the right to say you cannot use the work, including the following

quote:

(b) Scope and Exercise of Rights. — Only the author of a work of visual art has the rights conferred by subsection (a) in that work, whether or not the author is the copyright owner. The authors of a joint work of visual art are coowners of the rights conferred by subsection (a) in that work.
Dreamguy you can argue moraly as much as you want - i think everyone agrees that if the author of such work would come and say 'dont use my work' or their webpage says 'dont use my work' then TM and others wouldnt use their work. But unless the author comes forth and says that, i am of the (only semi informed, i admit - im not a lawyer) opinion that his use of the work falls under Fair Use.

okay, fair use law.

Fair use dictates you can make use of other peoples work as long as you dont claim it as your own. You should give credit as well, but as im not a lawyer i couldnt tell you if thats required as well.

TM, have you made any profit off anothers work and not sent them a cut, or have you claimed anyones work as soley your own?

No?

Then who cares?... I havent seen anyone saying 'hey, thats my work, and i dont want you using it.' im certain if that came up tm would go 'allright, no problem!'

the only time 'stealing' graphics is a problem (and hence, uneithical, in my view point) is if you claim it as your own. A friend of mine does some pretty decent bryce work, and one i stumbled across a site using one of his images as the background. The site even said 'i made the background image, aint it nifty?' now THAT is wrong and unethical.

Googling images to take them apart and use them as a combination of other images... is perfectly legal. 50% rule. If over 50% of the image i changed then its no longer the same image.

I think TM was refering to someone googling 'bear' and croping it to the approrpiate size. He would rather have someone draw a bear for him, as he cant do that himself

hey i dont know if this is on your guys to do list or not, but this would be a great feature if you could figure out how to add it - a paintbrush for raising and lowering hights. That rectangle tool is, imho, really really annoying to use.

just my 2bit suggetions :)

So far ive only seen 1x1 and 1x2 graphics in BoA. Is it no longer possible to do 2x1 and 2x2 graphics? i understand that the ammount of graphics would rise exponentionaly for a 2x2 (what would it be, 8 sheets?) so is the capability just not in the program to handle such graphics?

i do miss the 2x1's tho. Harder to get long sinuous creatures created these days.

In another note, like a bazillion other people who promise but probably never deliver im working on a scenerio. My fiance is making up a bunch of custom monster graphics, which we will post to louvre and link here so at the very lest while the scenario may be crap or more likey never come out, there will be some fun mob graphics. :P
