The point is that gov't intercession isn't putting C students in college over A students based on the color of their skin. Quotas can potentially do that, but there was a case a while back which made them specifically unconstitutional. The result is one group gaining an artificial edge which is more pronounced in lower grades. Income-based AA has also been suggested, and I'm personally for both. In both cases there exists a societal disadvantage which the student has no control over, and while there certainly shouldn't be, pretending it doesn't exist isn't going to fix it.
